Terms of Use

These Terms of Use (“Terms”) govern your access to and use of BankingBridge, LLC DBA Rates.now. and its affiliates’ websites, apps, and related products and services (collectively, the “Services”), including sites such as rates.now and mortgage.rates.now and our mobile apps (together, the “Site”). “BankingBridge, LLC,” “we,” or “us” refers to BankingBridge, LLC. and its affiliates; “you” refers to the individual user and, if applicable, the entity on whose behalf you use the Services. The Services are intended for U.S. residents.
By accessing or using the Services, you agree to these Terms (as updated under Section 9). Some Services may include additional or supplemental terms that you must accept to use those features.
Arbitration & Class Action Waiver. These Terms include a binding arbitration provision and class action waiver. If you do not agree, do not use the Services.

Third-Party Content, Products & Sharing

  • Third-Party Advice/Content. Provided for informational purposes only; BankingBridge is not responsible for third-party advice.

  • Third-Party Products/Services. Some offerings are provided by third parties (“Third-Party Providers”), not BankingBridge. Their terms govern those products. We are not liable for their acts/omissions.

  • Sharing Information. To use certain Services, you may share sensitive information with BankingBridge or third parties. You authorize BankingBridge to collect, store, use, and transfer such information as described in our Privacy Policy, including sharing with Third-Party Providers when you request or use their products.

  • Links. The Services may link to third-party sites. We do not control or endorse them and aren’t responsible for their content or practices.

Prohibited Conduct

You agree not to, among other things: use the Services unlawfully; infringe others’ rights; post unlawful/objectionable content; interfere with security or operations; spread malware; scrape, spider, or harvest data without permission; engage in fraud or impersonation; reverse engineer the Services (except as allowed by law); or transfer/sell your access.

Intellectual Property & Your Content

The Services and all related IP are protected by law. Trademarks belong to their owners. You warrant you own or have rights to content you submit.
For content you provide:

Indemnification

You will defend, indemnify, and hold harmless BankingBridge and its personnel from claims arising out of your content, your breach of these Terms/law, your infringement of others’ rights, or disputes with third parties. We may assume exclusive defense at our expense; you’ll cooperate.

Termination

We may suspend or terminate your account or access at any time for any reason. You may close your account via support@rates.now. After termination, we may retain information as permitted by law and as disclosed in our Privacy Policy.

Changes to These Terms

We may update these Terms by posting a new date and, where required, providing additional notice (e.g., email). Changes are effective upon notice. Continued use means acceptance. If you don’t agree, stop using the Services and close your account.

Disclaimers

The Services are provided “AS IS” and “AS AVAILABLE.” We disclaim all warranties (express/implied), including merchantability, fitness, non-infringement, and accuracy. We do not guarantee uninterrupted or error-free Services or the accuracy of content, tools, or outputs. Information is educational only—not legal, tax, insurance, or financial advice. Do not rely on tool outputs without independent verification. We do not warrant third-party products, services, or sites.

Limitation of Liability

To the fullest extent permitted by law:

  • No indirect/special/consequential/punitive damages or lost profits, data, or use.

  • Our total liability is limited to the greater of US$100 or the amount you paid us for the applicable Service. All limitations apply to Third-Party Products and Sites. Nothing here waives duties/rights that cannot be waived under securities laws.

Governing Law & Venue

These Terms are governed by South Carolina law and the Federal Arbitration Act. Subject to the arbitration requirement, the exclusive venue for permitted court actions is Charleston County, South Carolina.

Arbitration; Class Action Waiver

Most issues can be resolved by contacting support@rates.now. Otherwise, except for small-claims matters and certain IP/injunctive claims, disputes are resolved by binding arbitration under the AAA Rules, as modified by these Terms.

  • No jury trial. No class actions. Claims are on an individual basis only.

  • Procedures cover arbitrator authority, confidential proceedings, fees, notice and demand, venue, discovery, injunctive relief, future-change opt-out, severability, and mass/batch arbitration protocols (including grouping similar claims).

Service Modifications

We may modify, suspend, or discontinue any part of the Services at any time without liability.

General

  • Entire Agreement. These Terms plus the Privacy Policy (and applicable supplemental/partner terms) are the entire agreement.

  • No Waiver. Our failure to enforce is not a waiver.

  • Headings. For convenience only.

  • Severability. Unenforceable terms are enforced to the maximum extent; the rest remain in effect.

  • Partner Terms. If partner terms conflict with these Terms, these Terms control (unless expressly stated otherwise).

  • Third-Party Beneficiaries. Certain BankingBridge personnel may enforce indemnification and arbitration provisions; otherwise, no third-party beneficiaries.

We may modify, suspend, or discontinue any part of the Services at any time without liability.
